Track My Visa — Terms of Service

Summary (Plain-English; not legal terms)

Track My Visa provides tools to help you monitor case-status updates and view estimates and analytics. You may only track USCIS receipt numbers that you are authorized to track. We query the USCIS Case Status API only for receipt numbers you choose to track and certify you are authorized to track, subject to our safety controls and limits. A paid PRO subscription unlocks additional features and may allow more frequent status checks; basic case tracking may be available without a paid subscription. You can request deletion of your account and data, and you'll be asked whether you also want your Anonymized Analytics Data records to be deleted.

1. Parties and Scope

These Terms of Service ("Terms") are an agreement between you and MyVisa Immigration, Inc., a Delaware corporation, doing business as Track My Visa ("Track My Visa," "we," "us," or "our"). They govern your access to and use of our websites, applications, online services, dashboards, and related offerings (collectively, the "Services").

By using the Services, you agree to these Terms and to our Privacy Policy, which is incorporated by reference.

2. Definitions

  • "USCIS" means U.S. Citizenship and Immigration Services.
  • "Receipt Number" means a USCIS receipt number (also known as a case number).
  • "Case Data" means information related to a Receipt Number, including case status, case status history, and case metadata returned by USCIS and any metadata you provide in the Services.
  • "Subscription" means a paid plan that enables additional features for one or more cases, as described in the Services.
  • "Active Subscription" means a Subscription in good standing (paid and not canceled/expired).
  • "Consumer Services" means consumer-facing subscriptions and related features intended for personal/non-enterprise use.
  • "Enterprise Services" means business-facing offerings designed for higher-volume or organizational use.
  • "Anonymized Analytics Data" means analytics records used solely to generate aggregated statistics, graphs, reports, insights, and estimates, as described in the Privacy Policy.

3. Eligibility

You must be at least 18 years old and able to enter into a binding contract. If you use the Services on behalf of an organization, you represent you have authority to bind that organization.

No guarantee of outcomes. We do not guarantee approval, timelines, or results. Estimates are informational and may be inaccurate or incomplete.

Availability. The Services may change, be interrupted, or be unavailable.

5. Receipt Number Authorization (Required)

You may only enter or track a Receipt Number if you have explicit authorization from the applicant (and, if applicable, any other person or entity with rights to that information).

You represent and warrant that:

  • You are authorized to track each Receipt Number you submit; and
  • Your use complies with all applicable laws and regulations.

We may suspend or terminate accounts that we reasonably believe are being used to track Receipt Numbers without proper authorization.

6. Authorization, USCIS Queries, and Case Limits

6.1 USCIS queries

Track My Visa will query the USCIS Case Status API only for receipt numbers that you choose to track, for which you certify you are authorized to track, and subject to our abuse-prevention controls and limits.

A paid Subscription may unlock additional features and may allow more frequent status checks. If you do not have a paid Subscription, we may still perform basic status checks for cases you are actively tracking.

6.2 Consumer case limits

Consumer Services are limited to no more than ten (10) active tracked cases per account at any time (the "Consumer Limit"). In addition, you may not add more than ten (10) unique receipt numbers in any 30-day period.

If you legitimately need to track more than the Consumer Limit (for example, an immigration law firm or employer), you must use Enterprise Services.

6.3 Abuse prevention and enforcement

We may enforce limits, apply throttling, or restrict functionality as needed to protect the Services, comply with our obligations, and prevent misuse.

7. Accounts and Security

You may need to create an account to use the Services. You agree to:

  • Provide accurate information and keep it current;
  • Maintain the confidentiality of your credentials;
  • Promptly notify us of unauthorized access.

You are responsible for activity under your account.

8. Payments, Trials, Auto-Renewal, Cancellation

8.1 Billing and auto-renew

Some Services require payment. If you purchase a Subscription, you authorize recurring charges until you cancel. Prices and taxes are shown at purchase. You acknowledge that the amount of the recurring charge may increase if the applicable subscription fee increases.

8.2 Free trials

If a free trial is offered, it may automatically convert to a paid Subscription unless canceled before the end of the trial, as disclosed in the Services at sign-up.

Please note: your free-trial subscription will automatically renew as a paid subscription unless you cancel at least 1 hour before the end of the free-trial subscription period.

8.3 Cancellation

Cancellations take effect at the end of the current billing period unless stated otherwise in the Services. After cancellation, PRO-only features and any PRO-level status-check frequency will stop when the Subscription is no longer active. Basic tracking for cases you are actively tracking may still continue as described in Section 6.1. If your payment method fails or your account is past due, Track My Visa reserves the right to either suspend or terminate your Subscription.

8.4 Refunds

Fees are generally non-refundable except where required by law or where we explicitly state otherwise in the Services. Fees for paid Subscriptions are not prorated or refundable.

8.5 Charge disputes (time limit)

You agree to submit any disputes regarding any charge to your account in writing to Track My Visa within sixty (60) days of such charge, otherwise such dispute will be waived and such charge will be final and not subject to challenge.

9. Acceptable Use

You agree not to:

  • Scrape, crawl, data mine, or extract data from the Services without permission;
  • Reverse engineer or attempt to bypass technical controls;
  • Systematically download or store content from our Services without Track My Visa's specific, prior written consent;
  • Use the Services for unlawful, fraudulent, or abusive purposes;
  • Interfere with the Services or impose unreasonable load;
  • Frame or mirror any part of our Services without our specific, prior written consent;
  • Use the Services to track Receipt Numbers without authorization.

You also agree not to use any robot, spider, site search/retrieval application or other manual or automatic device to retrieve, index, scrape, or data mine the content of our Services without our express prior written consent. However, Track My Visa grants the operators of public search engines permission to use spiders to copy materials from the Services for the sole purpose of creating publicly available searchable indices of the materials. Track My Visa reserves the right to revoke these exceptions.

10. Intellectual Property

The Services and all associated content (text, graphics, software, charts, reports) are owned by Track My Visa or licensors and are protected by IP laws. You receive a limited, revocable, non-transferable license to use the Services for your internal, personal or business purposes (as applicable) under these Terms. You may not modify, distribute, reproduce, or create derivative works based on any material from the Website without Track My Visa prior written consent.

11. DMCA/Copyright Policy

Under the Digital Millennium Copyright Act and upon a proper written notice of alleged copyright infringement, Track My Visa will remove or disable access to the allegedly infringing content. Please submit your statement to Track My Visa by email at support@trackmyvisanow.com.

12. Feedback

If you provide suggestions or feedback, you grant Track My Visa a non-exclusive, worldwide, royalty-free right to use it without restriction or compensation.

13. Third-Party Services

The Services may integrate with or link to third-party services (for example, authentication providers, payment processors, communications providers, infrastructure providers, and analytics providers).

Our collection, use, sharing, retention, and deletion of Personal Information (including processing by our service providers) is described in the Privacy Policy.

14. Privacy and Data Processing (High-Level)

Our Privacy Policy explains what we collect, how we use it, how we share it (including with service providers), how long we retain it, and how deletion works.

15. Term Changes and Active Consent

Track My Visa will:

  • Maintain a record of Terms versions and your acceptance
  • Present Terms updates and a plain-English changelog

If we make material changes, we will ask you to affirmatively accept the updated Terms before continuing to use the Services. If you do not accept, you may stop using the Services and request deletion as described in the Privacy Policy.

16. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Track My Visa disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

17. Limitation of Liability

To the maximum extent permitted by law, Track My Visa will not be liable for indirect, incidental, special, consequential, or punitive damages. Track My Visa's total liability for any claim will not exceed the amount you paid to Track My Visa for the Services in the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations; these limitations apply to the extent allowed.

18. Indemnification

You agree to indemnify and hold harmless Track My Visa and its personnel from claims arising out of:

  • Your misuse of the Services;
  • Your violation of these Terms;
  • Your unauthorized tracking of Receipt Numbers;
  • Your violation of applicable law.

19. Dispute Resolution; Arbitration; Governing Law

These Terms are governed by Wyoming law, without regard to conflict rules. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Any dispute not resolved informally will be resolved by binding arbitration in Sheridan County, Wyoming, under AAA rules, except that either party may bring qualifying claims in small claims court and either party may seek injunctive relief for misuse of IP or unauthorized access.

20. California Notice

Under California Civil Code Section 1789.3, the following consumer rights notice is for California users of Track My Visa's Website.
