TERMS OF SERVICE

These Terms of Service (“Terms”, “Terms of Service”) are a legally binding agreement between you and MyVisa Immigration, Inc., a Delaware corporation doing business as Track My Visa (“Track My Visa,” “we,” “us,” or “our”). These Terms govern your access to and use of our website, dashboards, applications, and related tools and services (collectively, the “Services”).
Track My Visa provides tools that allow you to monitor immigration case status updates and view estimates, analytics, and related information. You may only track USCIS receipt numbers that you are authorized to access. By submitting a receipt number, you represent and warrant that you have the legal authority and permission to track that case. We query USCIS Case Status API for the receipt numbers you choose to track, subject to our security safeguards, rate limits, and operational controls.
Certain features of the Services may require a paid PRO subscription. Basic features may be available without charge, while paid subscriptions unlock additional functionality, including more frequent status checks and enhanced analytics.
Track My Visa is not affiliated with, endorsed by, or sponsored by any U.S. government agency. We are not a law firm and do not provide legal advice. Case Data presented through our Services are derived from USCIS Case Status API, and can be accessed for free at https://egov.uscis.gov/. We do not guarantee case approvals, timelines, or results. Estimates are informational and may be inaccurate or incomplete.
By accessing or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you must discontinue use of our Services.
You may request deletion of your account and personal data at any time. When submitting a deletion request, you will be given the option to also delete associated Pseudonymized Analytics Data, subject to our data retention and compliance obligations.
Definitions
- “USCIS” means U.S. Citizenship and Immigration Services.
- “Receipt Number” means a USCIS receipt number (also known as a case number).
- “Case Data” means information related to a Receipt Number, including case status, case status history, and case metadata returned by USCIS and any metadata you provide in the Services.
- “Subscription” means a paid plan that enables additional features for one or more cases, as described in the Services.
- “Active Subscription” means a Subscription in good standing (paid and not canceled/expired).
- “Pseudonymized Analytics Data” means analytics records used solely to generate aggregated statistics, graphs, reports, insights, and estimates, as described in the Privacy Policy.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract under the laws of your jurisdiction to use our Services. By accessing or using our Services, you represent and warrant that you meet these eligibility requirements and are not prohibited from entering into this agreement by any applicable law, regulation, court order, or governmental authority.
If you access or use our Services on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms of Service, and in that case, “you” and “your” refer to both you and that entity.
When you create an account or provide information to us, you agree that all information you submit is accurate, complete, and kept up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately if you suspect unauthorized access, misuse, or a security breach involving your account.
We reserve the right to suspend or terminate access to our Services if we believe eligibility requirements are not met, account information is inaccurate, the account is used in violation of these Terms of Service, or for any other reason at our sole discretion, with or without notice.
If we permanently terminate your access to the Services, we will handle retained information in accordance with the Privacy Policy and applicable law. Certain information may be retained as required by law, for legitimate business purposes, fraud prevention, dispute resolution, security, or compliance obligations. Anonymized or aggregated data that does not identify you may be retained.
2. Services and Important Disclosures
Nature of the Services. Track My Visa provides tools that allow users to monitor publicly available immigration case status information, view estimates, analytics, and access related features (collectively, the “Services”). The Services are offered through our websites, applications, and related platforms. Your use of the Services must comply with all applicable platform rules, laws, and regulations.
Track My Visa is not United States Citizenship and Immigration Services (USCIS) and is not affiliated with, endorsed by, or sponsored by any government agency. We are not a law firm and do not provide legal advice. The Services are informational only and are not a substitute for professional legal counsel.
No Guarantee of Outcomes. We do not guarantee case approvals, timelines, government actions, or any particular result. Estimates, analytics, and predictions are based on available data and modeling and may be inaccurate, incomplete, delayed, or outdated. You use the Services at your own discretion and risk.
Availability and Changes. The Services depend on internet connectivity, external systems, and third-party infrastructure. Interruptions, delays, or outages may prevent access to the Services. We may modify, suspend, discontinue, or change features, limits, or functionality at any time, with or without notice, and without liability.
Data and Privacy. When you utilize our Services, we collect and process information as described in our Privacy Policy. This may include personal information you provide and usage data necessary to operate and improve the Services. By using the Services, you acknowledge the Privacy Policy. We encourage you to review the Privacy Policy carefully.
3. Receipt Number Authorization
You may only submit, enter, or track a USCIS receipt number if you have explicit, lawful authorization from the applicant and any other person or entity with rights to that information.
By submitting any receipt number, you represent and warrant that:
- you have obtained all required permissions and consents to track that case;
- you are legally permitted to access and use that information; and
- your use of the Services complies with all applicable laws, regulations, and privacy obligations.
We reserve the right to suspend, restrict, or terminate any account that we reasonably believe is being used to track receipt numbers without proper authorization, or in violation of these Terms. We may request verification of authorization at any time, and failure to provide satisfactory verification may result in account suspension or termination.
4. Authorization, USCIS Queries, and Case Limits
4.1 USCIS queries
Track My Visa queries USCIS Case Status API systems only for receipt numbers that you choose to track and certify you are authorized to track. All queries are subject to our abuse-prevention safeguards, rate limits, and operational controls.
Certain features, including increased query frequency, may require a paid subscription. We may limit or adjust query frequency at any time to maintain system integrity, comply with third-party requirements, or prevent misuse.
4.2 Case limits
Accounts are limited to a maximum of ten (10) active tracked cases at any time. In addition, you may not add more than ten (10) unique receipt numbers within any rolling 30-day period.
4.3 Abuse prevention and enforcement
We may enforce limits, apply throttling, temporarily restrict functionality, or suspend accounts as necessary to protect the Services, comply with our obligations, or prevent fraud, scraping, automated abuse, or excessive system load.
Attempts to bypass limits, automate queries without permission, or use the Services in a manner inconsistent with their intended purpose may result in immediate suspension or termination without refund.
5. Accounts and Security
You may be required to create an account to access certain features of the Services. By creating an account, you agree to:
- provide accurate, complete, and current information and keep it updated;
- maintain the confidentiality of your login credentials;
- restrict access to your account and devices; and
- promptly notify us of any unauthorized access, suspected breach, or misuse.
You are fully responsible for all activity that occurs under your account, whether or not authorized by you. We are not liable for any loss arising from unauthorized use of your account resulting from your failure to safeguard credentials.
We reserve the right, in our sole discretion, to refuse service, suspend, or terminate accounts that violate these Terms or present a security risk.
6. Payments, Trials, Auto-Renewal, and Cancellation
6.1 Billing and auto-renewal
Certain Services require payment. By purchasing a subscription (“Subscription”), you authorize us or our payment processor to charge your payment method on a recurring basis until you cancel.
All fees, taxes, and billing terms are disclosed at the time of purchase. Subscription fees may change. If we increase pricing for any reason other than changes in applicable sales tax, VAT, or similar taxes, we will provide notice by email at least thirty (30) days before the change takes effect. We may adjust charges for changes in applicable taxes without separate notice. We may reduce pricing at any time without notice. Continued use after a billing change constitutes acceptance of the new price.
You acknowledge that recurring charges may vary due to pricing updates, taxes, currency adjustments, or platform fees.
6.2 Free trials
If a free trial is offered, it will automatically convert to a paid Subscription at the end of the trial period unless canceled before the trial ends.
You must cancel at least one (1) hour before the end of the trial to avoid being charged. Trial eligibility may be limited and determined at our discretion.
6.3 Cancellation
You may cancel your Subscription at any time through your account settings or the applicable app store or payment platform. Cancellation becomes effective at the end of the current billing period unless otherwise stated.
Upon cancellation, access to paid features will continue until the end of the current billing period and will then terminate. Free features, if any, may remain available.
If your payment fails or your account becomes past due, we may suspend or terminate your Subscription without notice. However, you will still be eligible to sign up for a new subscription.
6.4 Refund policy
Except where required by law, fees are non-refundable. Subscriptions are not prorated. Partial billing periods will not be refunded.
Nothing in this section limits mandatory consumer rights under applicable law.
6.5 Charge disputes
If you believe a billing error has occurred, you agree to notify us in writing within sixty (60) days after the charge appears on your statement so that we have an opportunity to investigate and address the issue. We do not waive any rights or defenses by reviewing or attempting to resolve a billing dispute. Initiating a chargeback without first contacting us may result in suspension of your account or Subscription, to the extent permitted by law.
7. Acceptable Use
You agree not to misuse the Services. Prohibited conduct includes, without limitation:
- Scraping, crawling, indexing, or extracting data without permission;
- Reverse engineering or bypassing technical safeguards;
- Systematically downloading or storing Service content;
- Using the Services for unlawful, fraudulent, or abusive purposes;
- Interfering with or overloading the Services;
- Framing or mirroring the Services;
- Tracking receipt numbers without authorization;
- Attempting to circumvent limits or automate queries.
You may not use robots, spiders, automated scripts, or similar tools to access the Services without prior written consent.
We grant public search engines limited permission to index publicly accessible content solely for searchable indexing. We may revoke this permission at any time.
Violation of this section may result in immediate suspension or termination of your account and possible legal action.
8. Intellectual Property
The Services and all software, content, analytics, text, graphics, designs, reports, trademarks, logos, and features (collectively, the “Content”) are owned by Track My Visa or its licensors and are protected by copyright, trademark, trade secret, and other intellectual property laws.
Except for the limited license granted below, Track My Visa retains all rights, title, and interest in the Services and Content.
8.1 Limited license
Subject to your compliance with these Terms, Track My Visa grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your internal, personal, or authorized business use.
You may not, and may not permit any third party to:
- copy, reproduce, distribute, or publicly display the Services or Content;
- modify or create derivative works;
- reverse engineer or attempt to extract source code;
- scrape, crawl, or systematically download data;
- remove copyright or proprietary notices;
- use our trademarks without written permission;
- use the Services to build a competing product.
Any unauthorized use automatically terminates your license.
8.2 User content
If you submit content, feedback, suggestions, or data to Track My Visa (“User Content”), you retain ownership of that content. However, you grant Track My Visa a worldwide, non-exclusive, royalty-free license to host, use, reproduce, modify, and display that content solely to operate and improve the Services.
You represent that you have all rights necessary to submit User Content and that it does not infringe the rights of any third party.
9. DMCA / Copyright Policy
Track My Visa respects intellectual property rights and expects users to do the same. We comply with the Digital Millennium Copyright Act (17 U.S.C. §512).
If you believe content on the Services infringes your copyright, you may submit a written notice including:
- your contact information;
- identification of the copyrighted work;
- identification of the infringing material and its location;
- a good-faith statement that use is unauthorized;
- a statement under penalty of perjury that your claim is accurate;
- your physical or electronic signature.

Upon receipt of a valid notice, we may remove or disable access to the content and notify the user who posted it.
9.1 Counter-notice
If you believe content was removed or disabled by mistake or misidentification, you may submit a counter-notice that includes your contact information, identification of the material that was removed or disabled and its prior location, a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification, a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which Track My Visa may be found, and your physical or electronic signature.
9.2 Repeat infringers
We reserve the right to terminate accounts of repeat infringers at our discretion.
10. Third-Party Services
The Services may integrate with or rely on third-party providers, including authentication services, payment processors, hosting and infrastructure vendors, analytics providers, communications services, and other technology partners (“Third-Party Services”).
We may share information with Third-Party Services as described in the Privacy Policy.
Track My Visa is not liable for interruptions, errors, or damages caused by Third-Party Services.
11. Privacy and Data Processing
Your privacy is important to us. Our Privacy Policy describes in detail:
- what information we collect,
- how we use it,
- how and why we share it (including with service providers),
- how long we retain it, and
- how deletion and data rights requests are handled.
By using the Services, you acknowledge that you have read and understood the Privacy Policy.
To the extent Track My Visa processes personal data on your behalf, you instruct and authorize us to process that data as necessary to provide the Services and as described in the Privacy Policy.
12. Term Changes and Active Consent
We may update these Terms from time to time. When we do, we will maintain a record of prior versions and provide a summary of material changes in plain language.
If we make any changes to these Terms, we will request your active consent of the updated Terms through a clear in-product prompt. Until you accept the updated Terms, your access to certain features may be limited or suspended.
If you do not agree to the updated Terms, you must stop using the Services. You may request deletion of your account and data in accordance with the Privacy Policy. For the current deletion methods, verification requirements, choice regarding Pseudonymized Analytics Data, and our target deletion timeline of approximately 72 hours after a verified request, please see Section 8 of the Privacy Policy.
13. Disclaimer of Warranties
The Services and all information provided through them are offered on an “as is” and “as available” basis.
To the maximum extent permitted by law, Track My Visa disclaims all warranties, express or implied, including warranties of:
- merchantability
- fitness for a particular purpose
- accuracy
- availability
- reliability
- non-infringement
- uninterrupted or error-free operation
We are not responsible for government systems, third-party infrastructure, data sources, or interruptions beyond our control.
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, our warranties are limited to the extent permitted by law.
14. Limitation of Liability
To the maximum extent permitted by law, Track My Visa and its employees, contractors, affiliates, and service providers will not be liable for:
- indirect damages
- incidental damages
- consequential damages
- special damages
- punitive damages
- loss of profits
- loss of data
- loss of business
- loss of goodwill
This limitation applies regardless of legal theory, including contract, tort (including negligence), strict liability, or otherwise.
14.1 Liability cap
To the maximum extent permitted by law, Track My Visa’s total aggregate liability for any claim arising out of or related to the Services will not exceed the greater of: (a) the amount you paid to Track My Visa for the Services in the twelve (12) months before the event giving rise to the claim; or (b) one hundred U.S. dollars (US$100).
Some jurisdictions do not allow certain liability limitations. In those jurisdictions, liability will be limited to the maximum extent permitted by law.
15. Indemnification
You agree to defend, indemnify, and hold harmless Track My Visa and its affiliates, employees, contractors, and service providers (the “Indemnified Parties”) from and against any third-party claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- your use or misuse of the Services;
- your violation of these Terms;
- your unauthorized tracking of receipt numbers or misuse of personal information;
- your violation of any applicable law or regulation;
- content, data, or materials you submit or transmit through the Services; or
- any claim that your actions infringed the rights of a third party, including intellectual property or privacy rights.
Track My Visa reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification. You agree to cooperate with our defense of such claims.
This indemnification obligation survives termination of your account and these Terms.
16. Dispute Resolution; Arbitration; Governing Law
These Terms and any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be governed by the laws of the State of Delaware, USA, without regard to its conflict of laws rules.
Nothing in this Section 16 limits any non-waivable consumer rights you may have under applicable law. If the law of the jurisdiction in which you reside does not permit mandatory arbitration, class-action waiver, or application of Delaware law to some or all disputes, then those non-waivable protections will apply to the extent required by applicable law.
Before filing any claim, you and Track My Visa agree to try to resolve the dispute informally by contacting the other party in writing and describing the dispute and requesting relief. If the dispute is not resolved within thirty (30) days after notice, either party may commence arbitration or, if eligible, bring the claim in small claims court.
Except for claims that qualify for small claims court and claims seeking injunctive or equitable relief for misuse of intellectual property, unauthorized access, or other misuse of the Services, any dispute arising out of or relating to these Terms or the Services will be resolved by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its applicable consumer or commercial arbitration rules, as applicable. The arbitration will be conducted on an individual basis in Delaware, unless the parties agree otherwise or the applicable AAA rules permit remote proceedings.
You and Track My Visa waive any right to a jury trial and, to the maximum extent permitted by law, any right to participate in a class action, class arbitration, or other representative proceeding.
If any provision of this Section is found unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect, except that if the class action waiver is found unenforceable, then this arbitration provision will be unenforceable to that extent.
17. Miscellaneous
These Terms, together with the Privacy Policy and any additional terms presented in connection with specific Services, constitute the entire agreement between you and Track My Visa regarding the Services and supersede prior or contemporaneous understandings relating to the Services.
You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign these Terms, in whole or in part, in connection with a merger, acquisition, reorganization, bankruptcy, sale of assets, or other change of ownership or control. Any transfer of Personal Information in connection with such an event will remain subject to the Privacy Policy, including its notice, deletion-opportunity, and protection commitments. We will provide any notice and obtain any consent required by applicable law and the Privacy Policy.
Our failure to enforce any provision of these Terms will not constitute a waiver of that provision or any other provision. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
We will not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including outages, failures of third-party services, internet or telecommunications failures, labor disputes, governmental actions, natural disasters, or other force majeure events.
Section headings are for convenience only and do not affect interpretation. Sections that by their nature should survive termination will survive termination, including provisions relating to intellectual property, disclaimers, limitations of liability, indemnification, dispute resolution, and miscellaneous terms.
